    1.0 PRIVACY POLICY AGREEMENT

    Dragon A/C & Heating Co. (The Company) values its users' privacy. This Privacy Policy ("Policy") will help you understand how we collect and use personal information from those who visit our website, make use of our online facilities or services, or provide their information to us and what we will and will not do with the information we collect. Our Policy has been designed and created to ensure those affiliated with The Company of our commitment and realization of our obligation not only to meet, but to exceed, most existing privacy standards.



    We reserve the right to make changes to this Policy at any given time. If you want to make sure you are up to date with the latest changes, we advise you to frequently visit this page. If at any point in time The Company decides to make use of any personally identifiable information on file, in a manner vastly different from that which was stated when this information was initially collected, the user or users shall be promptly notified by email. Users at that time shall have the option as to whether to permit the use of their information in this separate manner.



    This Policy applies to The Company, and it governs any and all data collection and usage by us.     In addition, The Company may have the occasion to collect non-personal anonymous demographic information, as well as the type of browser you are using, IP address, or type of operating system, which will assist us in providing and maintaining a superior online customer experience.

    1.3 USE OF INFORMATION COLLECTED

    The Company does not now, has not in the past, nor will it in the future, sell, rent or lease any of its customer lists and/or names to any third parties. The Company does not share mobile information (e.g. phone numbers) with third parties/affiliates for marketing/promotional purposes.



    The Company may collect and may make use of personal information to assist in the operation of our website and to ensure delivery of the services you need and request. At times, we may find it necessary to use personally identifiable information as a means to keep you informed of other possible products and/or services that may be available to you from us.



    The Company may also be in contact with you with regards to providing reviews, completing surveys and/or research questionnaires related to your opinion of current or potential future services that may be offered.



    The Company may feel it necessary, from time to time, to contact you on behalf of our other external business partners with regards to a potential new offer which may be of interest to you. Those third parties shall be strictly prohibited from making use of your personal information, other than to deliver those services requested, and as such they are required, in accordance with this agreement, to maintain the strictest of confidentiality with regards to all your information.

    • In other ways described in this Policy or to which you have otherwise consented;

    • As necessary to enforce the Terms of Service;

    1.5 NON-MARKETING PURPOSES

    The Company greatly respects your privacy. We do maintain and reserve the right to contact you if needed for non-marketing purposes (such as bug alerts, security breaches, account issues, and/or changes in The Company's products and services). In certain circumstances, we may use our website, newspapers, or other public means to post a notice.



    1.6 CHILDREN UNDER THE AGE OF 13

    The Company's website is not directed to, and does not knowingly collect personal identifiable information from, children under the age of thirteen (13). If it is determined that such information has been inadvertently collected on anyone under the age of thirteen (13), we shall immediately take the necessary steps to ensure that such information is deleted from our system's database.



    1.7 UNSUBSCRIBE OR OPT-OUT

    All online users and visitors to our website have the option to discontinue receiving communications from us. To discontinue or unsubscribe from receiving emails, send an email that you wish to unsubscribe to dragonacheating@gmail.com. To discontinue or unsubscribe from receiving text messages, text reply STOP. To discontinue receiving notifications in the mail, send an email that you wish to unsubscribe to dragonacheating@gmail.com. If you wish to opt-out from any third-party websites, you must go to that specific website to unsubscribe or opt-out. The Company will continue to adhere to this Policy with respect to any personal information previously collected.

    Our website does contain links to affiliate and other websites. The Company neither claims nor accepts responsibility for any privacy policies, practices, and/or procedures of other such websites. Therefore, we encourage all users and visitors to be aware when they leave our website and to read the privacy statements of every website that may collect personally identifiable information. This Privacy Policy Agreement applies only and solely to the information collected by our website.



    1.9 SECURITY

    The Company takes precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline. Wherever we collect sensitive information, that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a lock icon in the address bar and looking for "https" at the beginning of the address of the webpage.



    While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to personally identifiable information. The computers and devices in which we store personally identifiable information are kept in a secure environment.     By using this website, you are hereby accepting the terms and conditions stipulated within the Privacy Policy Agreement. In addition, your continued use of our website following the posting of any updates or changes to our terms and conditions shall mean that you agree and acceptance of such changes.

    1.0 INVOICING

    1.1 PAYMENT AGREEMENT

    Accounts not paid by the due date are subject to an 18% per annum finance rate, charged at 1.5% per month.



    1.2 LIMITED WARRANTY

    All materials and equipment are warrantied by the manufacturers' or suppliers' written warranties only. All service performed by Dragon A/C & Heating Co. (The Company) is warrantied for 30 days or as otherwise indicated in writing. The Company makess no warranties, express or implied, and its agents or employees are not authorized to make any such warranties on behalf of The Company.



    2.0 MAINTENANCE AGREEMENT

    2.1 LENGTH OF TERM & RENEWAL

    Purchase of a preventative annual maintenance agreement (The Agreement) entitles the customer to one spring and one fall (completed in order of whichever comes first) service for a 12-month period following the date of purchase. The Agreement renews once per year until cancelled.



    2.2 SCHEDULING

    No maintenance visits (Visits) will be scheduled on weekends or holidays. Visits are scheduled Mon-Fri, 8-5 with season start dates of spring in Apr and fall in Sept. Initial Visits may be scheduled any time of the year. Subsequent Visits for active Agreements prefer to be scheduled no later than May 31st for spring and Oct. 31st for fall. We ask that customers who are unable to be present during the Visit leave a key behind with a neighbor or allow remote access. It is not required for anyone to be present for the Visit, but the technician does need access to the thermostat and inside equipment to perform service.



    It is the customer’s responsibility to ensure all contact information is correct and notify Dragon A/C & Heating Co. (The Company) of any changes. After two attempts to schedule a prepaid Visit and no response is received, the Visit will be considered complete.



    2.3 DISCOUNT

    An active Agreement entitles the customer to a 5% discount off replacement parts for covered equipment located at the maintenance property address. Discount is valid on service, repair, or maintenance invoices and does not apply to equipment or major component install invoices.



    2.4 REFUND POLICY

    After two attempts to schedule a Visit and no response is received, no refunds, credits, or Visits beyond the 12-month period will be issued for the unscheduled Visit. The Agreement is transferrable to new residents; therefore, if the customer moves, the new resident is entitled to any prepaid Visits, provided The Company is able to contact the new resident. The Company reserves the right to cancel The Agreement at any time and for any reason. If The Company cancels The Agreement, the customer may be refunded for any uncompleted prepaid Visits.



    2.5 CANCELLATION POLICY

    Cancellations made 48 hours or less before a Visit will be subject to a charge of $15. This includes Visits where our technician is unable to access the property, is turned away, or the customer is unavailable. Cancellations made via email to dragonacheating@gmail.com or phone call/voicemail to 936-355-1083 sooner than 48 hours before a Visit will be processed without penalty. If The Company cancels a Visit with less than 48 hours' notice, no penalty will be charged to the customer.



    2.6 FORCE MAJEURE

    If and to the extent that either party’s performance of its obligations pursuant to The Agreement are prevented, hindered, or delayed directly or indirectly by causes beyond a reasonable control of such party, and such non-performance could not have been prevented by reasonable precautions, then the non-performing party shall be excused from these Terms & Conditions for as long as the Force Majeure Event continues or until both parties agree to cancel The Agreement. Upon mutual cancellation of The Agreement, the customer will be refunded for any uncompleted prepaid Visits.



    3.0 QUOTES

    3.1 FINANCING

    Financing is subject to credit approval. Monthly cost does not include sales tax and is for estimating purposes only.



    3.2 SALES TAX

    Depending on different factors, sales tax may or may not be collected on labor. Due to this circumstance and the accurate itemization of materials used, the sales tax may not be accurately assessed until the final invoice. Please see your quote details on whether or not sales tax is included in the quoted price.



    3.3 CANCELLATION POLICY & FEES

    Job cancellation after quote approval may result in a cancellation fee up to $200. Trip charge of $250 may apply if job site is not ready for us on the scheduled day. Special order or non-returnable items may be charged to the customer if the job is cancelled.



    3.4 CHANGE ORDERS

    Any changes to the work described within the quote must be agreed upon by all parties in writing. Any changes or damages may cost extra.



    Quotes are given based on the information collected as of the date of the quote. Any alterations made to the structure, design thereof, or collected information after the date of the quote may void the quote and result in a new quote in order to adhere to applicable codes.



    3.5 INVOICING

    Percentage progress invoices may be issued for rough-in and startup. All invoices are due in full upon receipt unless otherwise indicated in writing. Startups not completed within 180 days after rough-in will be invoiced for prepayment and due at that time.
